Hawkins Parnell & Young Secures Dismissal of Bentley Motors in Automotive Warranty Litigation

July 1, 2020 – Press Release

July 1, 2020 (Atlanta, GA) – Bill Wood and David Marshall of Hawkins Parnell & Young secured a dismissal for Bentley Motors in a breach of warranty case in the United States District Court for the Northern District of Georgia. Plaintiff alleged that he experienced various defects following the purchase of a motor vehicle for an amount totaling more than $280,000.00. Plaintiff claimed that the manufacturer breached written/express and implied warranties pursuant to Georgia’s Commercial Code and the federal Magnuson-Moss Warranty Act; he also asserted a breach of contract claim and sought damages for revocation of acceptance. Hawkins Parnell filed motions to dismiss Plaintiff's initial and amended complaints, and on June 24, 2020, U.S. District Judge Eleanor L. Ross dismissed all claims in their entirety against Hawkins Parnell's client.
