Contractor Prevails in Construction Arbitration

April 30, 2020 (Atlanta, GA) – Hawkins Parnell & Young partner Teresa Lazzaroni successfully defended a flooring contractor alleged to have negligently installed hard wood floors during new construction of a multi-million dollar residence. Plaintiffs filed claims against the builder and flooring contractor alleging breach of contract, negligent construction, and negligent supervision.

According to Plaintiffs’ expert the hard wood floors had not been properly acclimated prior to installation, and that, along with an irregular nailing schedule caused significant gapping and cupping to the hardwoods throughout the house. Plaintiffs also asserted other independent claims against the builder, which included, among other things, claims that the humidifier/dehumidifier systems installed in the house did not operate as designed and cost reconciliations. After a two day evidentiary hearing, which included dueling experts and significant post trial briefing, an arbitration award was issued vindicating the flooring contractor.
