Texas Court of Appeals Rules in Favor of Client J.P. Morgan Chase Bank, N.A.
April 11, 2012 (San Antonio, TX) – Rob Gilbreath teamed up with a San Antonio law firm to secure favorable rulings for J.P. Morgan Chase Bank, N.A. in two consolidated mandamus proceedings brought by J.P. Morgan in the Fourth Court of Appeals in Texas. The court of appeals held that the trial courts in the two cases abused their discretion by refusing to transfer venue to Tarrant County, Texas. In reaching its holdings, the Fourth Court disagreed with the Thirteenth Court of Appeals' ruling that the same venue statute did not apply in a case involving similar facts and claims. The Thirteenth Court's ruling is now before the Texas Supreme Court in a mandamus proceeding in which Rob represents J.P. Morgan. Rob is also representing J.P. Morgan in another Texas Supreme Court mandamus proceeding involving a trial court's abuse of discretion in refusing to require the plaintiffs to join necessary parties.
