HPY Wins Summary Judgment for Grocery Store in Premises Liability Case

March 22, 2018 (Atlanta, GA) – Hawkins Parnell & Young litigator Bryan Grantham obtained summary judgment for a local grocery store owner in Adel, Georgia, in a case filed by a customer who injured herself while fleeing from a small snake that she saw in the store. The customer claimed that the store had knowledge of similar incidents, and that they had superior knowledge of the snake at the time she saw it. The store owner countered that this was a first incident of its kind and that an employee of the store had been in the area five minutes prior and did not see a snake on the floor. The Court held that summary judgment in favor of the defendant was proper because the plaintiff failed to submit any evidence that the owner had superior knowledge of the hazard that allegedly caused her injuries.
