Hawkins Parnell & Young’s Jennifer Capabianco Obtains an Important Verdict in Alissa Guler v. Scoobeez Trucks Case

Hawkins Parnell & Young is excited to share a significant update regarding the legal case of Alissa Guler v. Scoobeez Trucks, which recently concluded in the San Mateo County Superior Court. Our legal team led by partner, Jennifer J. Capabianco, successfully represented Scoobeez Trucks in this case.

In January 2017, Ms. Guler was involved in a rear-end collision with a vehicle belonging to Scoobeez, a package delivery service. Despite the impact not causing significant vehicular damage, Ms. Guler reported experiencing physical injuries as a result of the accident including a concussion, strains, and even required surgery for a torn labrum in her hip.

Ms. Guler asked the jury to award $82,000.00 in past medical costs, $128,000.00 in past wages loss and $1,000,000.00 in non-economic damages for physical injury and emotional distress.

The case was complex, involving a combination of physical injuries and mental health challenges. It revolved around the interplay between perception and scientific facts. Our team argued that while Ms. Guler's perception linked her emotional distress to the accident, the scientific evidence showed otherwise. The defense presented expert testimonies to counter the claims, stating that the accident's impact and the subsequent injuries were not as severe as alleged.

After careful deliberation, the jury rendered a defense verdict, determining that Ms. Guler did not establish that the accident led to her claimed physical injuries or the subsequent decline in her mental health. The jury poll reflected a decisive 10-2 outcome.

This case serves as a testament to the power of diligent legal representation and the importance of distinguishing between perception and scientific facts.
