Hawkins Parnell & Young Secures Summary Judgment in Malicious Prosecution Case

August 18, 2020 (Atlanta, GA) – Hawkins Parnell & Young partner Bryan Grantham obtained summary judgment for a law firm in a malicious prosecution case brought by the spouse of a former client. The claimant alleged that the firm encouraged his wife to bring criminal charges against him for an alleged assault on the couple’s minor child. In the motion for summary judgment, the law firm argued that there was no evidence that it acted maliciously, that the arrest of the spouse was the result of an independent investigation, that there was probable cause for the arrest, and that even if the firm had encouraged the prosecution that it was protected by the attorney-client privilege. The trial court agreed and granted summary judgment for the law firm on all the claims made.
