Hawkins Parnell Obtains Dismissal for Automotive Gasket Manufacturer in Florida Federal Court

June 1, 2022 (Tampa, FL) – Hawkins Parnell & Young partner Todd C. Alley of the Atlanta office secured a dismissal with prejudice for an automotive gasket defendant in a personal injury lung cancer case alleging exposure to asbestos. Despite demonstrating weak evidence for product identification and cumulative exposure causation, the plaintiff refused to dismiss the defendant and continued to demand payment of settlement money. Todd filed a motion for summary judgment on the issues of product identification, asbestos fiber release, and specific causation. Promptly after oral arguments in the U.S. District Court for Middle District of Florida (Tampa Division), opposing counsel dismissed Hawkins Parnell's client with prejudice before the court ruled on summary judgment.
