Georgia Court of Appeals Affirms Daubert Ruling

June 15, 2011 (Atlanta, GA) – The Georgia Court of Appeals affirmed lower courts ruling that pathologist's specific causation opinion that each and every asbestos exposure contributes to disease does not satisfy the Daubert standard.  

Elaine Shofner with assistance from Craig Woods of Mayer Brown on behalf of Union Carbide Corporation extensively briefed the issue to strike Dr. Maddox's opinion that every asbestos fiber contributes. Oral argument and examination of Dr. Maddox at a Daubert hearing was handled by Woods. The Georgia Court of Appeals briefing and oral arguments was performed by Jim Grant of Alston & Bird with assistance from Shofner and Woods.
