David Marshall and Chris Lang Receive Favorable Verdict in Mold Exposure Case
December 9, 2010 (Marietta, GA) – David Marshall and Chris Lang successfully defended a lawsuit alleging personal injury, nuisance, breach of contract, and fraud in the state court of Cobb County, Georgia. Plaintiffs sued the partnership that owned the apartment complex where they lived, alleging damages from mold exposure as a result of multiple flooding events. Trial lasted nine days. The defense made an offer of judgment, which Plaintiffs refused. In closing argument, Plaintiffs' counsel asked the jury to award over $1.2 million in compensatory damages. In contrast, the defense suggested an award range between $5,000 and $10,000. The jury awarded the four Plaintiffs a total of $8,000 in damages. Plaintiffs' request for attorneys' fees and expenses of litigation were denied, and the jury further declined to assess punitive damages.
