Dallas Police and Fire Pension System Prevails in Texas Court of Appeals

July 21, 2017 – Press Release

July 21, 2017 (Dallas, TX) – Hawkins Parnell & Young's client Dallas Police and Fire Pension System prevails in Texas Court of Appeals. The City of Dallas appealed a trial court’s ruling that the DPFPS may maintain its claim for pension contributions in connection with a lawsuit by current and former first responders seeking backpay from the City. The City argued, among other things, that DPFPS was seeking retrospective relief, which is barred by the doctrine of sovereign immunity. The court of appeals rejected that and other arguments by the City, affirming the trial court’s ruling in favor of DPFPS. HPY appellate specialist Robert B. Gilbreath represented DPFPS in the appeal.
