Hawkins Parnell Secures Dismissal for Crane Company in Amputation Suit

May 2, 2025 – Press Release

May 2, 2025 (San Diego, CA) – Hawkins Parnell secured a complete dismissal for a large structural steel subcontractor in a case involving a catastrophic accident on a commercial construction project. Hawkins Parnell partners Elaine Fresch (Los Angeles), Jerry Popovich (Orange County), and Melanie Smith (San Diego) represented the firm's client in this high-exposure case brought by a prominent California firm.

The plaintiff alleged that a crane operator lifted the bridle hook when a defective, frayed portion of a tagline—allegedly supplied by Hawkins Parnell's client—became entangled with his foot. The plaintiff was lifted approximately 15 feet before falling, sustaining multiple fractures to his arm, wrist, leg, and ankle, along with back and neck injuries, head trauma, and, ultimately, a below-the-knee amputation after months of recovery.

After a comprehensive review of extensive documents and initial discovery, Hawkins Parnell proved their client was not responsible for the accident. As a result, the firm's client obtained a full dismissal without any judgment or settlement paid.
