This discussion will focus on ‘anchoring’ techniques used by plaintiffs at trial to inflate noneconomic damages. Why is this tactic effective and why is it allowed independent of the strength of the actual evidence in the case? More importantly, how can defendants effectively rebut and “cast away” plaintiffs anchor?
