Biography
David Lamm represents manufacturers, suppliers, and contractors in toxic litigation, product liability matters, and insurance issues. He routinely counsels business executives, handles complex cases, ensures legal and regulatory compliance, and implements risk management and loss avoidance strategies and programs. David also has handled the coordination of national and regional defense teams for Fortune 500 corporations and other major defendants as well as leading discovery planning and implementation. He has been involved in depositions, motions, and hearings in multiple jurisdictions throughout the United States.
David has defended clients in personal injury cases before juries in both Pennsylvania and West Virginia. Some of his past successes include:
- Saving millions of dollars in the representation of a client group in approximately 950 claims with no settlement monies paid in the West Virginia jurisdiction. He defended the same group in an Ohio based suit presenting a scientifically-based summary judgment argument resulting in the dismissal of all claims with no new claims filed.
- Serving as co-trial counsel in a manganese related case in Pennsylvania involving complex scientific and medical issues. He was able to establish for the jury that the plaintiff suffered from idiopathic Parkinson’s disease rather than a neurological disease alleged to have been caused by the client’s product.
- Representing a client group in manganese litigation, presenting scientific and medical issues to a West Virginia defense group to educate tangential allied stakeholders and effectively managing the litigation, resulting in the removal of the primary case.
- Removing thousands of case matters from West Virginia to a Federal MDL after discovering plaintiffs from Texas, with prior claims, in which there was testimony of employment in shipyards under Navy contracts, supported an argument for Federal Officer Removal. In this matter, David demonstrated that less than 100 plaintiffs, out of the thousands, had any connection to West Virginia.
- Defending a national manufacturer of excavating equipment in a product liability case, obtaining dismissal of a diversity-destroying defendant, forcing removal, and paving the way for a nuisance settlement.
