Hawkins Parnell Secures Dismissal for Transportation and Insurance Companies in Chicago Litigation

August 26, 2022 (Chicago, IL) – Hawkins Parnell & Young partners Catherine Goldhaber and Matthew Dowling obtained a dismissal for a national insurance company and a peer-to-peer carsharing company for lack of personal jurisdiction in Cook County, Illinois. Hawkins Parnell achieved the desired outcome for the clients at the pleading stage before any substantive discovery or costs.

The plaintiff attempted to assert jurisdiction over Hawkins Parnell’s clients for coverage on an insurance contract the plaintiff entered with a third-party individual. The declaratory judgment action sought to disavow coverage for the third-party individual based on a personal injury case stemming from a transportation accident in Florida. After fully briefing the motion and oral argument on the issues, the court dismissed Hawkins Parnell’s clients with prejudice.
