Defense Verdict in Pennsylvania

November 15, 2017 (Scranton, PA) – After a three-week trial in Pennsylvania, David C. Marshall secured a defense verdict for a global leader of cooling and heating products.

The trial started on October 30, 2017 with 11 defendants – 5 remained at the time of verdict – 3 furnace manufacturers, 1 boiler manufacturer, and 1 supply house. Plaintiffs’ brought claims on behalf of Mr. Robert Horst, who previously worked as a residential HVAC contractor from 1970-1978 in Lancaster, PA. Plaintiffs alleged Mr. Horst developed mesothelioma as a result of asbestos exposure from boiler and furnace removal, repair and installation.

The Pennsylvania Court of Common Pleas for Lackawanna County jury of 6 women and 4 men deliberated for two hours, returning a defense verdict in favor of all remaining defendants. The case was tried before Judge Terrance R. Nealon.
