Texas Supreme Court Grants Review in Case Filed by Client

March 29, 2013 (Austin, TX) – The Texas Supreme Court agreed to decide whether Nevada's statutory requirement that a judge, rather than a jury, decide the issue of alter ego applies in Texas courts. The lower courts held that this statutory requirement is merely procedural and therefore not binding on Texas courts even though Nevada law otherwise governs the case. Rob Gilbreath drafted the briefs urging the court to grant review and hold that the judge-versus-jury question is a matter of substantive law such that a judge must decide the alter ego issue when Nevada law applies.
