Georgia is a modified comparative fault state. That means that recovery is reduced (but not precluded) if the plaintiff is somewhat at fault, up to 49%. If the plaintiff is 50% or more at fault, recovery by him/her is prohibited. O.C.G.A. §51-12-33.
