June 10, 2019 (Austin, TX) – After a hotly contested four-day trial with significant media coverage, Hawkins Parnell & Young won a very favorable ruling from the Texas State Office of Administrative Hearings (SOAH). The SOAH found no evidence to support any of the 10 allegations against HPY’s client, a doctor and cosmetic surgeon from Austin, Texas.

The allegations against Hawkins Parnell's client included improper patient care for two patients, inadequate documentation of medical records, and disclosure of protected health information in violation of federal law. The Texas Medical Board alleged that the defendant improperly treated a patient by not actually performing liposuction on all areas for which she had paid, for failing to properly treat the patient when she was faint after the procedure, and for failing to keep proper medical records. 

With the risk of losing his license to practice medicine among other severe sanctions, Hawkins Parnell was retained on the Friday before the beginning of the trial on Monday. During the trial, the firm was able to have one of the patients state that she did not receive liposuction and then used the before and after pictures to impeach the witness. Hawkins Parnell crossed the nurse who had lied repeatedly on the stand and destroyed her credibility. After the trial concluded, Hawkins Parnell submitted lengthy briefs to the court as closing arguments.
