Hawkins Parnell Secures Summary Judgment Win for Chemical Manufacturer in Federal Court

June 15, 2022 (Atlanta, GA) – Hawkins Parnell & Young partners David C. MarshallEric T. Hawkins, and Robert B. Gilbreath secured summary judgment in the U.S. District Court for the Northern District of Georgia in favor of a chemical manufacturer in a products liability case after the court granted its Daubert motions to exclude plaintiff experts. The plaintiff claimed that he developed lung cancer, specifically a neuroendocrine tumor, after working with printing ink containing sulfuric acid and p-toluenesulphonic acid. The Hawkins Parnell team filed the summary judgment and Daubert motions arguing that the plaintiff could not provide sufficient evidence of general or specific causation. Chief U.S. District Judge Timothy C. Batten Sr. agreed with the argument presented by the defense in a 28 page order and noted that any speculative association by plaintiff experts lacked scientific support and entered judgment for the defendant.
