April 25, 2019 (Waco, TX) – Hawkins Parnell & Young secured a victory for H-E-B, a grocery chain with more than 400 stores, after a three day trial involving catastrophic injuries. The case arose when the plaintiff, an 80 year old woman, was operating an electric handicap scooter in an H-E-B supermarket. She alleged an employee negligently collided with her while pushing a trash cart with a wooden board extending from it which struck her in the side of the head, resulting in a concussion,  traumatic optic neuropathy, and traumatic brain injury. She claimed permanent incapacity, eventually ending in blindness.

Plaintiff’s counsel, Jerrell Wise of the Daniel Stark law firm, asked the jury for $10,080,000.00 in closing arguments. After deliberating for two hours, the jury returned a favorable verdict for the defense, assessing that the plaintiff was negligent and awarding her only $350.00 for physical pain. The case was tried before Judge Vicki Menard in the 414th Judicial District Court of McLennan County in Waco, Texas.
