Matt Barr Obtains Favorable Verdict in Premises Liability Trial

February 27, 2013 (Conyers, GA) – Matt Barr completed a jury trial in Rockdale Superior Court in Georgia before Judge David Irwin. The case involved a 2009 slip and fall at a McDonald’s restaurant. The plaintiff alleged that an employee did not put out any wet floor signs after mopping, resulting in the plaintiff’s fall and catastrophic injuries. The plaintiff never returned to work following the accident and was found to be disabled by the Social Security Administration. The plaintiff also presented testimony from an Emory University endocrinology expert that the fall exacerbated her preexisting diabetic neuropathy.

With a pre-suit demand of $850,000, the case proceeded to trial. At the directed verdict stage, Billy Davis successfully argued a motion to eliminate a substantial claim for future lost wages. 

After three and a half hours of deliberation, the jury returned a nominal verdict for the plaintiff, awarding only $2,042.23.
