Lithium-Ion Battery Manufacturer Victorious in California Federal Court

July 28, 2022 – Press Release

July 28, 2022 (Oakland, CA) – Hawkins Parnell & Young secured a dismissal for one of the world's largest manufacturers of lithium-ion batteries in a product liability case in the U.S. District Court for the Northern District of California. The plaintiff alleged an injury from an explosion of a lithium-ion battery used to power a vaping device.

Hawkins Parnell partners Ed UlloaFred Lee, and Macy Chan of the Los Angeles office argued that the plaintiff failed to timely prosecute the case against the firm's client and serve the complaint. Judge Jeffrey S. Wright agreed with the defense, granting the motion to dismiss. This outcome comes after a previous ruling dismissing the lithium-ion battery manufacturer based on a lack of personal jurisdiction, ending all claims by this plaintiff against Hawkins Parnell's client.
