Hawkins Parnell & Young Secures Significant Victory in Battery Manufacturer Case

(Monterey, CA) – Hawkins Parnell & Young won a motion for summary adjudication for a manufacturer of lithium-ion batteries in a products liability case in the Superior Court of California in the County of Monterey. Michael Giaquinto and Edward Ulloa of the Los Angeles office secured adjudication of a variety of causes of action against HPY’s client based on lack of proof of communication between the Company and the Plaintiff.

Plaintiff filed suit against Hawkins Parnell's client, alleging various claims, including breach of express warranty and negligent misrepresentation. After Michael and Ed conducted discovery and gained favorable admissions from Plaintiff’s deposition it was uncovered that there was no supporting evidence that HPYs client had any communications with the Plaintiff either in writing or verbally. Nor was there any evidence put forth regarding reliance by the Plaintiff to his detriment. It was also shown that a third party re-seller had removed the original wrapping of the battery cells before Plaintiff encountered them, which contained numerous warnings. In turn, the court granted the motion, adjudicating a number of causes of action against Hawkins Parnell's client.
