Hawkins Parnell Secures Summary Judgment for BorgWarner in Nevada Asbestos Litigation
February 5, 2026 (Las Vegas, NV) – Hawkins Parnell & Young secured summary judgment on behalf of Morse TEC, a BorgWarner company, in a mesothelioma case in the Eighth Judicial District Court. Eric Freeman, a partner in the firm's Las Vegas office, represented BorgWarner in the matter.
The plaintiff, who worked as an automotive mechanic for over 40 years, alleged exposure to asbestos-containing products. The plaintiff was represented by Maune Raichle Hartley French & Mudd, a national plaintiffs' firm that only handles mesothelioma cases.
The Hawkins Parnell defense team argued that the evidence and testimony presented did not support the claim that the plaintiff was exposed to any BorgWarner products on a regular basis over any extended period of time. The Court agreed, finding that the evidence failed to meet the substantial factor test required to establish causation in asbestos cases, and granted summary judgment in favor of BorgWarner.
