Hawkins Parnell Halts Lawsuit Against WPS with Summary Judgment in Los Angeles
March 6, 2023 (Los Angeles, CA) – Hawkins Parnell & Young litigators Elaine Fresch and Rosario Vizzie won a summary judgment motion for their client WPS USA Corporation in a product defect and premises liability lawsuit involving Dignity Health Hospital in Glendale, CA.
WPS, a leading expert in parking management that installs innovative, cloud-based parking systems at commercial retail and residential locations worldwide, was sued in the Superior Court of California in Los Angeles County for an incident involving one of its barrier gate systems at the Glendale hospital. After two rounds of vigorous oral argument and supplemental briefing ordered by the court, Elaine and Rosario demonstrated the lack of any genuine triable issue concerning the barrier gate's functionality, resulting in the court disposing of all claims against WPS.
The court issued a detailed 22-page order, relying on expert opinion and lay testimony concerning the operation of WPS' barrier gates, and concluded that the barrier gate operated as intended. The court agreed with WPS that the plaintiff's case, which hinged on various alleged system defects, lacked merit.
