Hospice Provider Dismissed in Fraud Allegations

May 1, 2014 (Atlanta, GA) – After two days of trial in the Superior Court of Fulton County, David Marshall and Debra LeVorse received a dismissal for Hawkins Parnell & Young’s client, a national hospice provider. Plaintiff alleged that the hospice provider committed fraud by executing documentation to provide hospice services, as opposed to home health, to the plaintiff without  consent. As a result of these alleged actions, plaintiff contended that her mother’s prescribed medications were discontinued, resulting in a morphine overdose which nearly resulted in death. The defense showed that the plaintiff was competent to and executed the hospice admission documents of her own free will and that the patient was appropriately certified for hospice care.
