Kathryn Whitlock is a panelist on the professional liability session, “Caught in the Web: Analyzing and Defending ADA Website Accessibility Cases.”
Kate will discuss how claims professionals and attorneys can combat the increasing wave of ADA website accessibility cases. Intended as a primer, this session will cover: a broad review of Title III of the Americans with Disabilities Act and its accessibility requirements; arguments on whether Title III of the ADA applies to websites and/or apps; potential standards for website accessibility; past efforts by the Department of Justice and Congress to provide guidance on website accessibility and potential changes under the Biden administration; defenses to Title III ADA website claims; discussion of potential state law claims, with particular focus on California’s Unruh Civil Rights Act; analysis of Title III ADA settlements and suggestions for drafting; and, strategies so that insureds can avoid litigation.
At the conclusion, attendees should possess a good working knowledge of Title III of the ADA and its application to website claims in order to guide future litigation and defend claims.
