Emilie de la Motte represents manufacturers, retailers, distributors, and contractors in toxic tort and product liability litigation, including cases arising out of claimed asbestos exposures, silica exposures, product defect allegations, and all other forms of mass torts. Emilie’s clients include local hardware store "mom and pop" owners, multi-national industrial manufacturers, and regional construction contractors. She also has experience in representing public entities and private parties in disputes that involve multi-party breach of contract, personal injury (both plaintiff and defense), ADA suits, ADR proceedings, complex discovery matters, and cases before the California Public Utilities Commission.
Emilie’s considerable experience in toxic tort and environmental litigation enables her to keep abreast of the current state of the law and craft complex motions, including motions to dismiss, summary judgment motions, and pre-trial motions to exclude an adversary's improper evidence. She is aggressive in digging deep into the evidence, understanding the core facts and points of contention, and poking holes in the adversary's case to obtain a favorable client result. She works closely with business owners and claim reps in keeping them timely informed as their cases progress. She is skilled in uncovering and understanding complex evidence found in voluminous discovery responses, subpoenaed records, depositions, and expert reports and then concisely and clearly explaining the key points to her clients in a manner that they can understand so they can make informed decisions.
Originally from San Luis Obispo, California, Emilie currently resides there with her two children, Rafael and Dominga. They recently returned from living three years in Chile, where she worked remotely for Selman Breitman. She is fluent in Spanish and French. When not helping clients with their legal needs, she spends her time learning Italian, skiing, volunteering, discussing novels with her book club, playing tennis, and planning her next travel destination.
