Defense Verdict for Multifamily Developer and Owner in Construction Defect Trial

August 15, 2022 (Atlanta, GA) – Hawkins Parnell & Young partner E. Tyron Brown obtained a defense verdict on behalf of a multifamily housing developer and owner in the Georgia Superior Court for Cobb County. The case arose when the plaintiff alleged that she burned herself after stumbling over a floor defect in her apartment while carrying a pot of boiling water.

Ty countered the allegations, showing the jury that there was no evidence of a slump or other construction defect on the floor. Plaintiff's counsel attempted to transform the case into an issue of habitability, which Ty anticipated and prevented. In closing arguments, the plaintiff's counsel asked the jury for $1 million in damages. The 12-person jury promptly returned a defense verdict in favor of Hawkins Parnell's clients.
