Will Insurers Head for the Door? Elaine Fresch and Eric Freeman Answer in CLM Construction Claims Article
October 1, 2023 (Las Vegas, CA) - Hawkins Parnell senior partner Elaine Fresch and partner Eric Freeman, from the Las Vegas office, co-authored an article published in the Fall 2023 issue of CLM Construction Claims, on Nevada's new legislation that is altering the state’s liability insurance landscape. Starting with an overview of Assembly Bill 398, which prohibits insurers from issuing policies with provisions that reduce the limit of liability coverage by the cost of defense and other expenses related to claims, the authors address how the bill is causing significant confusion in the state as it remains unclear how it will be interpreted and implemented.
The article explains that the Division of Insurance is working on permanent regulations to add clarity to the new rules, but in the meantime, there are more questions than answers and it is unknown whether the bill will cause insurers to leave Nevada.
