Reversal of ALJ's Decision Upholding an Agency Decision Obtained in Environmental Case

October 1, 2013 (Atlanta, GA) – Carl Anderson obtained a reversal of an administrative law judge’s decision upholding Georgia Environmental Protection Department decision to hold their client liable for clean-up costs in a Georgia Hazardous Site Response Act case in the Fulton County Superior Court from Judge Alfred Dempsey. Judge Dempsey determined that both the agency and the administrative law judge had misconstrued the plain language of the statute in an effect to hold the client liable for clean-up costs.
