Rita Glenn v. 3M Company, et al.
Claire Weglarz of Hawkins Parnell & Young, LLP, and Mark Tivin of O'Connell, Tivin, Griffin & Burns, LLC, secured an outright dismissal mid-trial in a wrongful death mesothelioma case pending in Anderson County, South Carolina. Their client, a sealing product manufacturer, was one of five defendants remaining at trial. The Hon. Jean H. Toal presided over the trial.
Plaintiff alleged that her deceased husband’s mesothelioma was caused by his work with the client’s packing products during his work at several Duke Energy facilities throughout South Carolina from 1970 into the 2000s.
The client was dismissed after Weglarz’s opening statement and the testimony of several witness, including Arnold Brody, a cell biologist cross-examined by Tivin.
