Peter A. Jacxsens, Jr.

Biography

Pete Jacxsens advises and defends businesses and professionals in high-exposure civil litigation and trials throughout Georgia, including manufacturers, landowners, transportation companies, and insurers. He also counsels clients on litigation avoidance, trial strategy, budgeting, and negotiations. Pete focuses on delivering cost-effective services by providing thorough initial investigations and straightforward legal analyses of claims to determine whether they should be disposed of early or prepared for trial.

Professional Expertise

  • First-chaired several recent jury trials with favorable outcomes for his clients including a difficult case tried in the State Court of Fulton County involving a child head injury. Pete obtained the dismissal with prejudice of the sole defendant, an apartment complex owner, following the first day of testimony in the case where the last pre-trial demand was in the high six figures.
  • As national coordinating counsel for a manufacturer in fire pot litigation, he managed lawsuits pending across the country and nearly 100 pre-suit claims.
  • Obtained pre-hearing dismissal of a FINRA arbitration brought by a former employee against the firm and two associated persons as well as the expungement of another FINRA arbitration arising out of a customer dispute.
  • Pete tried a case brought by a homeowner against a contractor alleging defective workmanship resulting in property damage. At the conclusion of the trial, Pete obtained a judgment for the contractor on the homeowner’s claims and was awarded damages on the contractor’s counterclaim against the homeowner for the balance due for the work completed.
  • Pete has also tried premises liability cases and cases alleging property damage due to rainwater and surface water runoff to verdict with favorable results for his clients.
  • Pete successfully represented the defendants in a complicated federal estate case where the Plaintiff alleged that the defendants had exercised undue influence over an elderly family member prior to his death. The Plaintiff brought claims for breach of fiduciary duty, conversion, fraud, conspiracy, deceptive trade practices and punitive damages. Prior to trial, the Federal Court granted summary judgment to the defendants on all the Plaintiff’s claims.
  • Pete obtained the dismissal of million dollar counterclaims against a home improvement company on spoliation of evidence grounds
